Milanoo Wins a Victory Against Domain Name Infringement Lawsuit

On November 11, Milanoo successfully regained .cc domain name is the officially authorized domain name of Cocos and Keeling islands which are located in the Indian Ocean next to northwest Australia. As CC is the abbreviation of “Commercial Company”, it has gained the popularity among more and more individuals and companies which lead .CC became the third commonly used top level domain after .COM and .NET in America.

Global B2C foreign trade entrusted Washington law firm to place a case on file for arbitration in July of this year. An American local court accepted and submitted the case to WIPO (the world intellectual property organization). The complainant Milanoo filed the lawsuit against the owner (hereinafter, the defendant) of disputed domain name claiming that the disputed domain name was registered in May of 2011 while registration was accomplished on December 12 of 2007 and its official online operation started from the beginning of 2008. Since the establishment, Milanoo has used to launch its global businesses. After five years’ development, the company now owns English, French, German, Japanese, Italian, Spanish, Portuguese and Russian sites which cover more than 180 countries and regions. Therefore, the complainant thought that the disputed domain name is easy to be mixed up with Milanoo trademark.

Apart from the above, Milanoo provided relevant evidence to prove that the defendant has taken a long time advantage of the similarity of the domain name to steal existing number of searches and attention of and mislead customers to buy at his site by keyword search. The defendant transferred a lot of customer complaints to Milanoo at the same time when he earned a profit by taking advantage of brand recognition and attention of Therefore, the defendant has the crime of malicious registration and employment.

In conclusion, WIPO delivered a final ruling that belongs to milanoo without a dissent. At the same time, another disputed domain name was ruled own by milanoo. Milanoo spokesman, Xu Yuan said, “The determined protection for intellectual property rights and brand value is our policy all along. With the expanding of foreign trade business all over the world, we need to equip ourselves with stronger brand protection awareness and legal consciousness. We will resolutely safeguard ourselves by legal means when facing behaviors which are bad for our brand assets.
